Overview

The law impacts on all business activity. Whether dealing with customers, suppliers or employees, or protecting the physical and intellectual assets of your business, it is essential that business people have some knowledge of the appropriate legal issues. An understanding of commercial law and its operation will aid both those who make business decisions and those who advise others on business decisions.

Commercial Law:

  • enables students to read and understand laws relevant to business made by Parliament, and decisions by the courts on the application of those laws;
  • equips students with the tools to recognise the legal implications of business activities; and
  • provides students with an understanding of the policies that drive legal developments within a commercial context.

Commercial Law at Victoria provides a grounding in the modern law of commerce. It includes the important areas of contract law, company and partnership law, competition law, labour and marketing law. It also covers up-to-the-minute developments in the law of e-Commerce.

A Commercial Law major along with a major in one of Accounting, e-Commerce, Marketing, Management, Finance, Taxation, Public Policy, or Human Resource Management and Industrial Relations is a powerful combination. You'll have a degree that gets you ready to make business happen.

Undergraduate Information

The Bachelor of Commerce and Administration (BCA) requires:

  • A total of 360 points to complete the degree (3 years full-time study).
  • The completion of seven core 100-level courses.
  • The completion of at least one major.

The Commercial Law Major

The School offers a range of courses in commercial law that can substantially broaden your understanding of other areas of commerce that you may be focusing on in your study. These include contracts, which are an essential element of every business transaction, the laws underpinning various options for structuring your business or company, the law relating to employment and human resource management, legal issues for e-Commerce, marketing law and competition law, law for the banking industry and the laws relevant to international trade.

The current Commercial Law major consists of the following courses:

Commercial Law

  • COML 203, 204; one course from COML 205, 206, TAXN 201
  • COML 310; two further courses from COML 300-399*

* One of these may be replaced by an approved course from TAXN 300-399.

If you began your course of study in or before 2008 please contact your Student Administration Adviser in the Faculty of Commerce (Victoria Business School) to confirm your major requirements.

Commercial Law is also part of the accounting and taxation majors and the academic requirements of the accounting professional bodies. Further information on qualifying as a professional accountant, can be found in the Accounting Profession and Careers section.

COML 111 Law for Business

An alternative more general introduction course to COML 203 is provided by COML 111. When offered, this course is designed to give students an appreciation of legal issues concerning the formation and management of business enterprises including the formation and management of business entities, employment law, intellectual property and fair trading, anticompetitive trade practices, issues in tax law and the law relating to electronic commerce. It is suitable for students wanting a single course on the legal issues encountered by business enterprises. It can also be used as a pre-requisite for some of the 300-level COML papers. Please check the course catalogue to see if COML 111 is being offered in the current year.

The Commercial Law Minor

Under the 2011 statute, it is possible to complete a commercial law minor. This consists of 60 points from COML at 200 and 300-level, with at least 15 points at the 300-level.

Postgraduate Information

Postgraduate Qualifications in Commercial Law

The school offers graduate certificates and diplomas in Commercial Law.

Postgraduate Degrees

While there is no dedicated Commercial Law Honours programme, it is possible to add Commercial Law Honours courses  to any of the BCA(Hons) programmes.

The School of Accounting and Commercial Law also offers the Master of Commerce and Administration and the PhD programmes for advanced level postgraduate study in Commercial Law.
