The terms of the declaration that you must agree to when applying to Victoria University of Wellington.

Applicant declaration

When applying for admission to the University, you will need to read and agree to the following declaration. The information contained in your application must be true, correct and complete.

  1. I declare that the information provided in this application is true, correct and complete, and that no information that would have a bearing on my admission has been withheld. If requested, I will provide any further information or documentation to the University (including any information necessary that the University requires under the Education (Pastoral Care of Tertiary and International Learners) Code of Practice 2021.
  2. I understand that the University may decline or terminate my application, withdraw, amend or substitute an offer, decline or cancel my enrolment, or apply other measures it considers appropriate if:
    1. I withhold information or provide false, misleading, incorrect or incomplete information; or
    2. I do not provide on time any information or documents required by the University to support my application.
  3. I specifically acknowledge that submitting fraudulent, forged, or otherwise dishonest documentation in support of my application will disqualify me from enrolment. I understand that the University reserves the right to inform all other New Zealand universities of this fact, along with my name and date of birth, and that the Police and Immigration New Zealand may also be informed.
  4. I understand the University may decline my application or offer me an alternative programme of study if I do not meet the University’s admission and enrolment requirements or the requirements for my chosen programme of study.
  5. I understand that in addition to the academic requirements of this programme, further requirements may be necessary for my chosen career. These could include other qualifications, registration with a professional body, licensing, or other legal requirements. I understand that it is my responsibility to be aware of these additional requirements and to ensure that I can meet them.
  6. I understand and agree that the University may collect, use, retain and disclose personal information about me in accordance with its Privacy Notice, Privacy Policy, and the Privacy Act 2020.
  7. I will comply with the University’s statutes, regulations, policies, and procedures.

Student agreement

When you accept an offer of study, or when you accept an enrolment agreement, an agreement is formed between you and Te Herenga Waka—Victoria University of Wellington (the University). This agreement, which is called the Student Agreement, includes the terms and conditions below as well as the statutes, policies, regulations and procedures of the University.

    Enrolment

  1. When enrolling, you confirm that you have checked the details of your enrolment and you accept enrolment in the listed qualification and courses and confirm they are correct. You will complete the enrolment process by promptly paying or satisfying the fees and charges listed on the invoice.
  2. You confirm that all the information you provide to the University is true, correct and complete. You understand that if you withhold information or provide false or misleading information, your enrolment may be declined or terminated. You acknowledge that the submission of fraudulent, forged, or otherwise dishonest documentation in support of your application will disqualify you from enrolment. In such a case, the University reserves the right to inform all other New Zealand universities of this fact, along with your name and date of birth, and notify the Police and Immigration New Zealand.
  3. You understand that you will not be enrolled into a course or programme unless your application complies with the University’s admission and enrolment requirements, relevant qualification regulations, and any additional conditions advised by the University.
  4. You will update the University as soon as practicable if any information that you have provided to the University changes. You understand that in addition to the academic requirements of any programme, further requirements may be necessary for your chosen career. These could include other qualifications, registration with a professional body, licensing, or other legal requirements. You understand that it is your responsibility to be aware of these additional requirements and to ensure that you can meet them.
  5. Your obligations

  6. You agree to comply with the statutes, policies, regulations, and procedures of the University (as amended from time to time), and all other reasonable instructions or requirements of the University, and you accept the jurisdiction of the University in matters connected with your studies.
  7. Without limiting clause 5 above, you agree to read and comply with the Student Conduct Statute, which outlines the behaviours expected of students enrolled at the University and what you can expect from the University where misconduct is suspected. A breach of the Student Conduct Statute may result in penalties imposed on you by the University. These penalties may include, withdrawal or suspension of access, academic penalties, or in the worst cases suspension or exclusion from the University or, if you are a resident in a hall of residence, exclusion or eviction from that hall of residence.
  8. You agree that you will use your reasonable endeavours to fulfil the requirements specified by the University for your programme of study.
  9. You understand that your University email address (and/or your preferred email address, if you have specified one), will be the University’s primary means of communication with you about matters relating to your enrolment and studies at the University. Emails sent by the University to your University email address (or your preferred email address) will constitute written notice to you. You are responsible for checking these email addresses regularly (at least once a week). The University may also provide written notice to you by other means.
  10. Fees and payment

  11. You must pay by the relevant due date the full amount of any fees and levies relating to each course you enrol in (or request enrolment in) as prescribed by the University. Unless your eligibility for Fees Free has been confirmed by the Tertiary Education Commission, you will be liable for full University fees and levies.
  12. If any amounts are not paid by the due date, you acknowledge that you are not entitled to be (or remain) enrolled and the University has the right to cancel your enrolment. If the University doesn't cancel your enrolment, you agree to pay all applicable late fees and reinstatement fees. You also agree to reimburse the University for all third party legal and collection costs incurred by the University in recovering any overdue amounts.
  13. You acknowledge that the country you live in during your period of study may influence whether you are classed as a domestic student or an international student and therefore the amount of the fees and levies you are required to pay. You acknowledge that the University reserves the right to charge any additional taxes payable in New Zealand or in your country of study if required by any relevant law.
  14. You acknowledge that non-payment of fees, ceasing to attend or verbally advising a member of staff will not be accepted as notice of withdrawal. Information on withdrawals and refunds (including the circumstances in which you may be entitled to a refund of all or part of you fees) is available in the Fees Policy and on the University website.
  15. You acknowledge that if your course or programme involves an industry placement or internship, you may be required to travel away from the University campus (including outside of Wellington) for the placement or internship. You understand that you will be responsible for meeting your own travel and living costs relating to your placement or internship.
  16. Our obligations

  17. The University will use its reasonable endeavours to provide you with tuition and supervision of a professional standard in the programme of study and the courses in which you are enrolled, and act reasonably and fairly in exercising its powers.
  18. The University may make changes to its courses and programmes (including the offering, content, mode of delivery, fees, or timing for delivery of courses or programmes) including where such changes are required because of changes in funding, staffing, legislation, Government directions, or circumstances beyond the University’s reasonable control. The University will give you reasonable notice (having regard to the circumstances) of any such changes.
  19. Health, Safety and Wellbeing

  20. The University prioritises the health, safety and wellbeing of its staff and students.  You acknowledge that:
    1. in order to minimise risk to health and safety, you must comply with health and safety requirements and/or restrictions set by the University from time to time and notified to you (including requirements and/or restrictions that may be imposed in response to epidemics of pandemics, such as COVID-19).  This could include, for example, restrictions on your ability to access the University’s campus, facilities (including halls of residence), or services based on your COVID-19 vaccination status;
    2. the University may take certain actions (including actions that may have an impact on you) under the Education (Pastoral Care of Tertiary and International Learners) Code of Practice 2021.
  21. You will notify the University if you have any concerns about your health, wellbeing, safety or your ability to study and will update the University if your health needs (including mental health needs) change.  This is so that we can offer you appropriate support and, where relevant, assist you to access additional services.  We also ask that you notify the University if you have concerns about discrimination, racism, bullying, harassment or abuse, or the health, wellbeing and safety of other students.
  22. Privacy

  23. You understand and agree that the University may collect, use, retain and disclose personal information about you in accordance with its Privacy Notice, Privacy Policy, and the Privacy Act 2020.
  24. You agree that you have read and understood the University’s Privacy Notice. In particular, you understand and agree that the University may collect information about you from third parties, that University staff will have access to your personal information where they have a genuine need to do so, that information about you may be disclosed to third parties, and that the University may contact your next of kin or emergency contact person, the Police, or other relevant person or agency (including appropriate University staff) if the University is concerned about your engagement, academic progress, behaviour, safety, security or wellbeing (or the safety, security or wellbeing of others).
  25. You will provide the University with any information or documentation reasonably requested by the University (including any information that the University requires under the Education (Pastoral Care of Tertiary and International Learners) Code of Practice 2021.
  26. You will update the University as soon as practicable if any information that you have provided to the University changes (including but not limited to your contact details, current address while studying, immigration status, and contact details for your next of kin or emergency contacts, and for your parents/guardians if you are under 18 years of age).
  27. When participating in an international exchange or study abroad programme, you understand that your information, including your personal details, academic progress, results, medical conditions and your wellbeing in an emergency, will be shared with the relevant international educational institution for the purposes of your participation in the relevant programme. You acknowledge that your information will therefore be shared outside New Zealand and that it may not be given the same protection as provided by the Privacy Act 2020.
  28. International students

    If you are an international student:

  29. You must meet the requirements of Immigration New Zealand to study in New Zealand. You must hold a valid visa and comply at all times with the conditions of that visa (this is a pre-requisite of your enrolment and a condition of your continued enrolment). If you intend to travel to and/or study in New Zealand, you must have and maintain appropriate health and travel insurance either from the University’s preferred insurance provider or from a provider which is compliant with the requirements of the Education (Pastoral Care of Tertiary and International Learners) Code of Practice 2021.
  30. Information about your academic progress or withdrawal, including grade and wellbeing information, may be provided to or shared with your agent, homestay host, sponsor or home university upon request under agreements that facilitate your enrolment into the University, for the purposes of providing you with academic and pastoral support or for the provision of transfer of credit and evidence relating to compliance with conditions of entitlement to study.
  31. You understand and agree that Immigration New Zealand can disclose to the University, and the University can disclose to Immigration New Zealand, any information that it holds that is relevant to your immigration status.
  32. General

  33. The University may require that any written work submitted (including any research interest statement) be subject to plagiarism detection software and systems. You agree that a copy of your written work may be held, stored and analysed in the plagiarism detection systems operated or used by the University and plagiarism detection providers.
  34. To the maximum extent permitted by law, the University’s liability to you is limited to the amount of tuition fees, levies, general fees and any other charges on your fees account that you have paid for the enrolment period in which the liability arises. The University is not liable to you for any indirect or consequential losses (including loss of opportunity, loss of future earnings or loss of reputation), or for any losses, costs or damages that you suffer or incur as a result of a breach of this Student Agreement by the University where that breach is caused by circumstances beyond the University’s reasonable control.
  35. If you do not, or cannot, comply with the requirements of this Student Agreement, the University may terminate this Agreement and your enrolment at the University by written notice to you. This is in addition to the University’s rights under its statutes, policies, regulations, and procedures. The University will comply with the principles of natural justice in exercising its rights under this clause. This means that if the University is considering terminating this Agreement, the University will notify you in writing and provide you with a reasonable opportunity to respond. The University will consider any response that you provide before making a final decision and notifying you of that decision. Any decision to terminate this Agreement will be made by an impartial decision maker.
  36. Any dispute arising out of or in connection with this Student Agreement, or otherwise relating to the performance of this Student Agreement by either party, shall be resolved through the applicable procedures prescribed by the University in the relevant statutes, policies, regulations, and procedures or as otherwise required or permitted by law (for example, under the relevant Student Contract Dispute Resolution Schemes).
  37. This Student Agreement comes into force when you accept an offer of study, or you accept an enrolment agreement, and continues for your period of enrolment (see clause 10.5 of the Admission and Enrolment Regulations), or until you cease to be enrolled (see clauses 11 and 12 of the Admission and Enrolment Regulations) or until the Agreement is terminated under clause 28 above (whichever occurs first). However, certain provisions in this Agreement still continue to apply. These include paragraphs 9 to 13 (fees and payment), 18-22 (privacy), 26 (academic integrity), 27 (liability), 29 (disputes), 31 (governing law) as well as this paragraph 30 and any other provisions that by their nature are intended to continue to apply.
  38. This Student Agreement is subject to and governed by the laws of New Zealand.
  39. The University may update this Student Agreement from time to time by updating the Student Agreement webpage. From the date of each update, the most recent version of this Student Agreement will apply to you and will replace any previous version(s) of this Student Agreement.
